EU Declaration of Conformity

One of the most important duties of the manufacturer is to identify possible hazards associated with the product and then eliminate them. With regard to machines, this means a complex validation process that, in accordance with the safety rules detailed in the Machinery Directive, finally authorizes the evaluation company/evaluator to issue the EU Declaration of Conformity and consequently allows to mark the machine with CE sign.

In case of new machines and devices, the CE marking by the producer will allow free purchase/sale in the countries of the EU-community.

The CE mark can also be given to a machine that has been imported from outside the European Union. Then it is necessary to implement the procedure of adapting the machine to the requirements of directives in force in the EU.

The CE mark (fr. Conformité Européenne), required by the European Union for every product. A sign confirms the product meets all the requirements in terms of health, safety or environmental protection. The “New Approach” of the European Union from 20th of April 2016.

The CE mark must be given before placing the product on the market.

DECLARATIONS OF CONFORMITY – MANDATORY CONTENT

WE DECLARATION OF CONFORMITY FOR MACHINES:

This declaration and its translations must be made under the same conditions as the manual, in the form of a typewriter or in capital letters.

This declaration applies only to the machine in the state in which it was placed on the market and does not cover components added by the end-user or subsequent activities carried out by him.

The declaration must contain the following particulars:

  • 1. The company name and full address of the manufacturer and, if applicable, his authorized representative;
  • 2. The name and address of the person residing or having its registered office in the EU Community who is authorized to prepare the technical documentation;
  • 3. Description and identification of the machine, including a generic term, function, model, type, serial number and trade name;
  • 4. The sentence containing an explicit statement that the machinery meets all the relevant provisions of this Directive and, if applicable, a similar sentence containing a declaration of compliance with other Community Directives or the relevant provisions that machinery must comply with. These statesments must refere the texts has been published in the Official Journal of the European Union;
  • 5. Where appropriate, the name, address and identification number of the notified body which carried out the EC type-examination referred to in Annex IX and the number of the EC type-examination certificate;
  • 6. Where appropriate, the name, address and identification number of the notified body which approved the full quality assurance system referred to in Annex X;
  • 7. Where appropriate, a reference to the harmonized standards used referred to in Article 7 par. 2;
  • 8. Where appropriate, a reference to other technical standards and specifications used;
  • 9. Place and date of submission of the declaration;
  • 10. The identity and signature of the person authorized to draw up the declaration on behalf of the manufacturer or his authorized representative.

The EU Declaration of Conformity is translated into Polish if it has been prepared in another language.

The EU Declaration of Conformity and its translations must be drawn up under the same conditions as the typewritten manual or handwritten in capital letters.

The machine manufacturer or his authorized representative shall keep the original EU Declaration of Conformity for a period of at least 10 years from the date of manufacture of the last copy of the machinery.

DECLARATION OF INCLUDING MACHINE NOT COMPLETED

This declaration and its translations must be made under the same conditions as the manual, in the form of a typewriter or in capital letters.

The declaration of incorporation must contain the following particulars:

  • 1. The company name and full address of the manufacturer of the partly completed machinery and, where applicable, his authorized representative;
  • 2. The name and address of the person residing or established in the Community, authorized to prepare the relevant technical documentation;
  • 3. Description and identification of the partly completed machinery, including a generic term, function, model, type, serial number and trade name;
  • 4. Sentence containing a statement which of the essential requirements of this Directive is applied and fulfilled and that appropriate technical documentation has been prepared in accordance with Annex VII, Part B, and, where applicable, a statement containing the declaration of conformity of the partly completed machinery with other Community Directives. These statesments must refere the texts has been published in the Official Journal of the European Union;
  • 5. An undertaking to provide, on reasoned request from the national authorities, relevant information on the partly completed machinery. The undertaking covers the method of transfer and does not infringe the intellectual property rights of the manufacturer to the partly completed machinery;
  • 6. A statement that the partly completed machinery cannot be put into service until the final machinery into which it is to be built-in obtains a declaration of compliance with the provisions of this Directive, if appropriate;
  • 7. Place and date of submission of the declaration;
  • 8. The identity and signature of the person authorized to draw up the declaration on behalf of the manufacturer or his authorized representative.

The partly completed machinery manufacturer or his authorized representative shall keep the original declaration of incorporation for a period of at least 10 years from the date of manufacture of the last piece of partly completed machinery.

FEATURES OF THE CE MARK

  1. In the case of a reduction or enlargement of the CE marking, the proportions given in the above figure must be observed.
  2. The individual components of the CE marking must have substantially the same height, which may not be less than 5 mm. For machines of small size, a deviation from the minimum dimension is allowed.
  3. The CE marking must be placed in the immediate vicinity of the name of the manufacturer or his authorized representative, using the same technique.
  4. The CE mark must be placed by the manufacturer on the product in a visible, legible and durable manner.
